
From February 14, 2025, Circular 29/2024/Circular- Ministry of Education and Training regulations on tutoring and further learning are officially in effect. Accordingly, Circular 29/2024/Circular- Ministry of Education and Training have specified the circumstances in which tutoring and further learning are prohibited and have regulated tutoring and further learning activities inside and outside the school. To help teachers, parents, and students understand more about the above regulations, INLaw Vietnam would like to send readers the following article.
Tutoring and extra-learning activities inside and outside the school are specifically defined in Clause 2, Clause 3 Artical 2 of Circular 29/2024/Circulaw Ministry of Education and Training as follows:
“1. Tutoring and further learning are additional teaching activities in addition to the duration specified in the educational plan for subjects and educational activities (hereinafter collectively referred to as subjects) in the General Education Program, the Continuing Education Program at the lower secondary level, etc The upper secondary continuing education programme is issued by the Minister of Education and Training.
2. Tutoring and further learning in schools is the activity of tutoring and further learning conducted by general education institutions, continuing education institutions, other educational institutions General education programs, Continuing education programs at the secondary level, etc The general secondary continuing education programme (hereinafter collectively referred to as the school) organizes its implementation.
3. Tutoring and extra learning outside of school is a tutoring and extra learning activity not organized by the school specified in Clause 2 of this Article.”
“Article 4. Cases in which no further teaching is provided, the institution of further teaching
1. Do not organize tutoring for elementary school students, except in the following cases: artistic training, physical education and sports, and life skills training.
2. Teachers who are teaching at schools that are not taught in addition to the school collect money from the student for the student to whom the teacher is assigned to teach according to the school's educational plan.
3. Teachers from public schools are not allowed to participate in managing and operating extra-school tutoring but can participate in extra-school tutoring.”
So there are 3 things that parents and students need to pay attention to avoid confusion:
Circular 29/2024/Circular - Ministry of Education and Training specific redulations on case of turoring in school in clause 1, Articale 5 of Circular 29/2024/Circular-Ministry of Education and Training as follows:
“Article 5: Tutoring and further learning in schools
1. Tutoring and tutoring in schools is not allowed to collect money from students and is only for students who register for tutoring in each subject as follows:
(a) Students whose academic results at the end of the adjacent semester have not been achieved;
(b) Pupils selected by the school for the training of good pupils;
c) Senior students voluntarily register to study for entrance exams and graduate exams according to the school's education plan.”
For tutoring and extra-school activities, Circuar 29/2024/Circular-Ministry of Education and Trainging there are regulations governing operations
“Article 6. Teaching and studying outside of school
1. Organizations or individuals organizing tutoring and extra learning activities outside the school that collect money from students (hereinafter collectively referred to as tutoring facilities) must fulfill the following requirements:
(a) Register your business according to the provisions of law;
(b) Publicity on the electronic information portal or listing at the place where the tutoring institution is located about the subjects in which tutoring is organized; the duration of tutoring in each subject in each grade; the place, form and time in which tutoring and tutoring are organized; list of tutors and the number of tuition fees before enrolling in tutoring and tutoring classes (according to Form No. 02 in the Appendix attached to this Circular).
2. Extra-school tutors must ensure good moral qualities; have professional capacity appropriate to the subjects participating in tutoring.
3. Teachers teaching at schools participating in extra-school tutoring must report to the Principal or Director or head of school (hereinafter collectively referred to as the Principal) about the subject, location, form, time of participation in extra teaching (according to Form No. 03 in the Appendix attached to this Circular).”
