
Circular No. 29/2024/TT-BGDĐT, issued by the Ministry of Education and Training, came into effect on February 14, 2025. This regulation introduces new provisions governing private tutoring and supplementary education, to alleviate academic pressure, mitigate negative practices in education, and ensure equitable access to knowledge. In light of these newly established requirements for teachers engaged in private tutoring, INLaw Vietnam presents this article to provide essential information to assist educators in preparing for the lawful operation of their tutoring businesses.
Individuals or organizations seeking to register a private tutoring business may choose from the following legal business structures: sole proprietorship, private enterprise, partnership company, limited liability company, or joint-stock company. In practice, most individuals and organizations opt for the sole proprietorship model (household business) to conduct tutoring activities.
- Legal Requirements
In addition to selecting an appropriate business structure, individuals or organizations establishing a private tutoring business must comply with legal regulations concerning business registration, tax obligations, and other financial duties.
If registering as a household business, the applicant must submit a registration request to the Economic and Planning Division of the District-level People’s Committee where the tutoring business is located.
If registering as an enterprise, the applicant must complete the registration process with the Department of Planning and Investment.
- Facility Requirements
The tutoring facility must meet the minimum standards for classrooms, teaching equipment, lighting, sanitation, and student safety. If the tutoring business operates outside of a school setting, it must have a fixed location that does not disrupt public order or traffic safety.
- Teacher Requirements
Individuals engaged in teaching at tutoring centers must possess professional qualifications relevant to the subjects they teach, maintain good ethical standards, and comply with all educational regulations. Teachers currently employed in public schools are prohibited from establishing or managing private tutoring centers, in accordance with Circular No. 29/2024/TT-BGDĐT.
- Curriculum Requirements
The content taught in tutoring classes must adhere to the curriculum prescribed by the Ministry of Education and Training. It is strictly prohibited to alter, omit, or teach material in advance of the official school curriculum. Additionally, tutoring centers must not impose excessive academic pressure on students or compel them to enroll in supplementary classes under any circumstances.
Compliance with these legal requirements ensures that private tutoring businesses operate within the law, fostering a healthy learning environment where students can enhance their knowledge without undue stress or academic burden.
To engage in private tutoring services for a fee outside the formal school system, individuals or organizations registering as a household business must prepare the following documents:
Application for Household Business Registration (using Form Appendix III-1 under Circular No. 02/2023/TT-BKHDT).
Note: The industry code for private tutoring services to be entered in the application is *Code 8559 – Other Education Not Elsewhere Classified.
A copy of the legal identification document of the business owner and household members registering the household business.
Accepted documents include: Citizen Identification Card or Identity Card.
A copy of the meeting minutes of household members regarding the establishment of the household business (if multiple household members are involved in the registration).
A copy of the authorization document from household members appointing one member as the household business owner (if applicable).
Currently, business registration can be completed through two methods: online submission or in-person submission.
The applicant (individual or organization) must prepare the required documents and submit them online via the National Public Service Portal.
The district-level business registration authority will issue a receipt confirmation and process the application electronically through the business registration information system.
The applicant will receive the result via the online system once the review process is completed.
The applicant must prepare the complete set of required documents and submit the application to the district-level business registration authority where the business is to be located.
For example: In Ho Chi Minh City, District 1, applications should be submitted to the Finance – Planning Division of the District 1 People’s Committee.
Processing time: Within three (3) working days of submission:
If the application is valid, the district-level business registration authority will issue the Household Business Registration Certificate.
If the application is incomplete or incorrect, the authority must provide a written notice explaining the reasons for rejection within the same timeframe.
